Terms of Service

These Terms describe the rules for using this website and the general conditions that apply to business discussions with Perigee Growth LLC.

Effective: October 2, 2026

Website use and service scope

Visitors may use this website for lawful business information and inquiries. They may not interfere with operation, attempt unauthorized access, transmit harmful material, misrepresent identity, scrape protected information, or use content in a way that violates law or third-party rights. Our professional services may include affiliate program setup and management, partner and creator development, campaign coordination, performance analysis, and reporting. The exact services for a client are stated in a signed contract or statement of work. Website descriptions are general and do not require us to accept an engagement, provide every listed activity, or begin work before commercial terms are agreed.

Client responsibilities and third-party platforms

Clients are responsible for accurate product details, lawful advertising claims, brand approvals, inventory and pricing decisions, required disclosures, platform permissions, and timely feedback. They must have the authority to provide every account, file, trademark, creative asset, or dataset shared with us. Affiliate networks, publishers, creators, analytics providers, payment processors, and communication services are independent third parties. Their availability, policies, account approvals, attribution methods, fees, enforcement actions, and technical performance are outside our full control. A client remains responsible for reviewing and complying with the terms of platforms and markets it chooses to use.

Performance, fees, and service changes

Affiliate and digital marketing results depend on market demand, product value, pricing, competition, inventory, partner interest, promotional terms, customer experience, tracking, attribution, and other factors. We do not guarantee any number of partners, placements, impressions, clicks, conversions, sales, rankings, or revenue. Fees, deposits, invoice timing, reimbursable expenses, payment methods, renewal terms, and late-payment consequences are defined in the client agreement. Work outside the agreed scope requires written approval and may affect fees or timing. We may pause work when required information, access, approvals, or payments are overdue, subject to the applicable agreement.

Intellectual property and confidentiality

Clients retain rights in their names, trademarks, product information, original materials, and other resources they provide. Perigee Growth retains rights in pre-existing methods, operating processes, expertise, frameworks, and reusable materials. Ownership or permitted use of engagement-specific reports, campaign resources, research, or other deliverables is governed by the signed agreement. Each party should protect non-public information received through a potential or active engagement and use it only for authorized purposes. Confidentiality does not cover information that is public without breach, independently developed, lawfully received from another source, or required to be disclosed by law.

Disclaimers, liability, and disputes

The website is provided on an as-available basis. To the extent permitted by law, we disclaim warranties not expressly stated in a signed agreement. We are not responsible for indirect, incidental, special, punitive, or consequential losses arising from website use, third-party platforms, or professional services, except where such limitation is prohibited. Additional liability limits may appear in a client agreement. Before filing a formal claim, the parties should provide written notice and attempt good-faith business resolution. Governing law, venue, arbitration, or other dispute procedures for contracted services are established in the applicable signed agreement.

Business relationship and written agreements

This website provides general information about Perigee Growth LLC and a channel for business inquiries. Submitting a form, sending an email, or reviewing website content does not create a client relationship, authorize work, or replace a signed agreement. Services begin only after the parties complete appropriate discussions and agree in writing to scope, responsibilities, timing, fees, and other commercial terms. If a signed contract or statement of work contains terms that differ from this website policy, the signed agreement controls for that engagement to the extent permitted by applicable law. Prospective clients should retain a copy of every agreement and policy relevant to their services.

Electronic communications and records

Clients and prospective clients may communicate with us through email, website forms, shared workspaces, or other approved business channels. They are responsible for providing accurate contact information and for protecting access to their own accounts. We may retain correspondence, approvals, project records, invoices, and delivery confirmations when reasonably needed for service performance, security, dispute handling, legal obligations, and legitimate business administration. Electronic communications can be delayed, filtered, misdirected, or accessed through a compromised account. Sensitive credentials should not be sent through an unapproved channel, and suspected account compromise should be reported promptly.

Policy updates and interpretation

We may revise this policy when our services, operational practices, legal obligations, or third-party relationships change. The updated version will be posted on this website with an effective date. Changes apply prospectively unless applicable law requires another approach. Headings are provided for readability and do not limit the meaning of the underlying text. If one provision is found unenforceable, the remaining provisions continue to apply to the extent allowed by law. A delay in enforcing a provision does not permanently waive the right to enforce it. Nothing on this website should be interpreted as legal, tax, accounting, or investment advice.
